These Terms of Use (“Terms”) govern your access to and use of the website located at https://newroofsinc.com (the “Website”), operated by New Roofs, Inc. (“New Roofs,” “we,” “us,” or “our”). By accessing or using our Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Website.

1. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use this Website or place an order. By using the Website, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Use of the Website

You agree to use the Website only for lawful purposes and in a manner consistent with these Terms. You agree NOT to:

  • Use the Website in any way that violates applicable federal, state, or local laws or regulations
  • Impersonate another person or misrepresent your affiliation with any person or entity
  • Engage in any conduct that restricts or inhibits anyone’s use of the Website
  • Use any robot, spider, scraper, or other automated means to access the Website without our prior written consent
  • Attempt to gain unauthorized access to, interfere with, or disrupt any part of the Website, its servers, or networks
  • Introduce viruses, malware, or other harmful code
  • Collect or harvest information about other users
  • Use the Website to transmit unsolicited advertising or promotional material
  • Use the Website to send fraudulent quote requests or place fraudulent sample orders

“New Roofs,” the New Roofs logo, and related names and marks are trademarks of New Roofs, Inc. Third-party trademarks displayed on the Website (such as GAF, CertainTeed, Mastic, Mule Hide, and James Hardie) belong to their respective owners and are used for identification purposes only.

You may view, download, and print pages from the Website for your own personal, non-commercial use, provided you do not modify the content or remove any copyright, trademark, or other proprietary notices. Any other use requires our prior written permission.

4. Quote Requests and Free Estimates

The Website allows you to request a free quote or estimate for roofing, siding, solar, or related services. Please understand:

  • All quotes and estimates provided through the Website are preliminary and non-binding until confirmed in writing after an on-site inspection.
  • Final pricing depends on factors that can only be assessed in person, including roof condition, structural elements, material availability, scope of work, and site access.
  • Submitting a quote request does not create a contract for services. A contract is only formed when you and New Roofs sign a written services agreement.
  • Quote responses, project timelines, and pricing are subject to change based on conditions discovered during inspection or changes in material costs.

By submitting a quote request, you authorize us to contact you by phone, email, or text message about your inquiry. You may opt out of communications at any time.

5. Sample Orders and E-Commerce

The Website offers product samples (such as shingle and siding swatches) for purchase. The following terms apply to all sample orders:

Pricing and Payment. All samples are priced as listed on the Website, plus a flat shipping fee. Prices are in U.S. dollars. Payment is processed at checkout via Stripe or PayPal. By placing an order, you authorize us (and our payment processors) to charge your selected payment method for the total amount of your order.

Order Acceptance. Submission of an order is an offer to purchase. We reserve the right to accept or decline any order, including for reasons such as suspected fraud, product unavailability, or pricing errors. If we cannot fulfill your order, we will issue a full refund.

Shipping. Samples are shipped to the address you provide at checkout. Shipping times are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or other circumstances outside our control.

Sample Purpose. Samples are provided for color, texture, and material evaluation only. Samples may vary slightly in color and appearance from full installations due to variations in production runs, lighting, and screen rendering.

Returns and Refunds. Due to the nature of sample products and the modest shipping-cost basis on which they are priced, samples are non-returnable and non-refundable except where required by law or where a sample arrives damaged or defective. If you receive a damaged or incorrect sample, please contact us within 14 days of delivery and we will make it right.

Risk of Loss. Title and risk of loss for samples pass to you upon delivery to the carrier.

6. Service Contracts and Workmanship Warranty

These Terms govern your use of the Website only. They are separate from any service contract you may enter into with New Roofs for roofing, siding, solar, or related work. Any work performed by New Roofs will be governed by a separate written services agreement signed by both parties.

Our 10-year workmanship warranty on new roof installations is described in the applicable services agreement and warranty documents provided at the time of installation. Manufacturer warranties (such as those provided by GAF, CertainTeed, Mastic, Mule Hide, or James Hardie) are issued by the manufacturer and governed by the manufacturer’s separate warranty terms.

7. Insurance Claims Assistance

New Roofs may assist customers in navigating insurance claims related to roofing damage. This assistance is provided as a courtesy and does NOT constitute:

  • Legal advice
  • Insurance advice or representation
  • A guarantee of claim approval or any specific outcome
  • Public adjusting services (unless separately disclosed and contracted)

You remain solely responsible for the accuracy of information submitted to your insurance company and for all communications and decisions regarding your claim. We recommend consulting with your insurance agent or a licensed professional for specific advice about your policy and claim.

8. Referral Reward Program

New Roofs offers a referral program in which existing customers may receive a $250 Visa gift card for qualifying referrals. Program eligibility and payout are subject to the following conditions:

  • A referral form must be submitted prior to the execution of a contract for the new roof installation
  • The referred customer must complete a paid roofing installation with New Roofs
  • The referred customer must not have previously been in our customer database or quote pipeline
  • Reward is issued only after the referred customer’s installation is complete and payment is received in full
  • Limit one reward per qualifying referral
  • Rewards may not be combined with other promotional offers unless explicitly stated
  • New Roofs reserves the right to modify, suspend, or terminate the referral program at any time
  • Tax implications of receiving the reward are the responsibility of the recipient

Additional program-specific terms may apply and will be presented at the time of referral submission.

9. User-Generated Content

If you submit content to the Website — including blog comments, reviews, referral information, or any other materials (“User Content”) — you grant New Roofs a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with operating and promoting our business.

You represent and warrant that:

  • You own or have the right to submit the User Content
  • The User Content is accurate and not misleading
  • The User Content does not violate any law or infringe any third party’s rights (including copyright, trademark, privacy, or publicity rights)
  • The User Content does not contain defamatory, obscene, harassing, or otherwise objectionable material

We reserve the right (but have no obligation) to remove, edit, or refuse any User Content at our sole discretion. We are not responsible for User Content posted by others.

10. Third-Party Links and Services

The Website contains links to third-party websites and services (including social media platforms, manufacturer sites, payment processors, and affiliate organizations). We provide these links for convenience only. We do not control, endorse, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are governed by their own terms and policies.

11. Disclaimers

THE WEBSITE AND ALL CONTENT, MATERIALS, AND PRODUCTS PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, NEW ROOFS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any content, including pricing, product descriptions, color representations, or availability.

This Section does NOT affect or limit:

  • Our 10-year workmanship warranty on completed roof installations (as described in the applicable services agreement)
  • Manufacturer warranties on installed products
  • Any rights you may have under applicable consumer protection laws that cannot be waived

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEW ROOFS, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE, INCLUDING (BUT NOT LIMITED TO) LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NEW ROOFS THROUGH THE WEBSITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

This limitation does NOT apply to claims arising under a separately executed services agreement for roofing, siding, solar, or related work, which is governed by that agreement’s own terms.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless New Roofs, Inc. and its owners, employees, contractors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Website
  • Your violation of these Terms
  • Your User Content
  • Your violation of any law or third-party right

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in Waukesha County, Wisconsin, and you consent to the personal jurisdiction of those courts.

15. Dispute Resolution

Informal Resolution First. Before filing any formal claim, you agree to first contact us in writing and give us 30 days to resolve the dispute informally. Most disputes can be resolved this way.

Class Action Waiver. To the fullest extent permitted by law, you and New Roofs each waive the right to bring or participate in any class action, collective action, or representative proceeding against the other.

16. Termination

We may suspend or terminate your access to the Website at any time, with or without notice, for any reason — including violation of these Terms. Upon termination, your right to use the Website ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

17. Changes to These Terms

We may update these Terms from time to time at our sole discretion. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify you through a notice on the Website. Your continued use of the Website after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy and any separately executed services agreement, constitute the entire agreement between you and New Roofs regarding your use of the Website and supersede all prior agreements or understandings on that subject.
